Dal 1° febbraio 2007, per un incidente con un altro veicolo per danni alle cose trasportate di proprietà, al veicolo e/o lesioni non gravi alla persona e con parziale o nessuna responsabilità bisogna rivolgersi direttamente alla propria assicurazione che è tenuta a risarcire il danno.

* Ci si può rivolgere alla propria assicurazione solo in caso di coinvolgimenti di soli 2 veicoli entrambi identificati, assicurati ed immatricolati in Italia. Se uno dei due veicoli (o entrambi) è un ciclomotore, deve essere targato secondo il nuovo regime entrato in vigore il 14/07/ 2006. La nuova procedura di risarcimento diretto si applica quindi a tutti i ciclomotori immessi in circolazione da questa data , mentre a quelli già in circolazione a questa data, si applica soltanto se abbiano volontariamente aderito al nuovo regime. Se oltre alle cose trasportate ed al veicolo ci sono danni fisici, deve trattarsi di lesioni non gravi, cioè con invalidità permanente non superiore al 9%. La procedura di risarcimento diretto si applica anche se sul proprio o sull’altro veicolo coinvolto sono presenti, oltre ai conducenti, altre persone che hanno subìto lesioni anche gravi (cioè con invalidità permanente superiore al 9%).
* Negli altri casi bisogna rivolgersi all’assicurazione del veicolo che si ritiene responsabile, in tutto o in parte, dell’incidente.
* La richiesta di risarcimento può essere consegnata a mano alla propria assicurazione o inviata a mezzo lettera raccomandata a.r. o a mezzo telegramma o posta elettronica certificata se prevista da contratto.

Il termine di 60 giorni si riduce a 30 giorni se è stato sottoscritto da entrambi le parti il modulo di constatazione amichevole (C.A.I.).
Per questo è molto importante che la richiesta di risarcimento sia completa di tutti gli elementi richiesti dalla legge. Per preparare la richiesta ci si può rivolgere alla propria agenzia assicuratrice che è tenuta ad offrire l’assistenza necessaria anche ai fini della quantificazione dei danni alle cose ed al veicolo. Se la richiesta è incompleta di qualche elemento essenziale, l’agenzia d’assicurazione è tenuta ad informare l’assicurato richiedendo l’integrazione mancante.
Per questo è molto importante che la richiesta di risarcimento sia completa di tutti gli elementi richiesti dalla legge. Se non si raggiunge l’accordo con la propria assicurazione si potrà sempre adire le vie legali. Al di fuori di questi casi, il danneggiato dovrà richiedere il risarcimento all’assicurazione del veicolo responsabile. In caso di sinistro con veicolo non assicurato o non identificato la richiesta dovrà essere rivolta al Fondo di garanzia per le vittime della strada presso la Consap. Nel caso di sinistro con veicoli esteri all’Ufficio Centrale Italiano.

Ugur Sahin e Mallett danno vita alla Corvette Z03
Quando leggiamo il nome di Ugur Sahin sappiamo che parliamo di un designer unico, quando poi associamo il suo nome allazienda Mallett Cars, che ricordiamo è una ben nota azienda americana per aggiornamenti al motore, siamo convinti che il risultato è ottimo.
Circa un anno fa abbiamo visto i primi disegni della Corvette ZO3, con una potenza massima di 700 cavalli. Chiaramente questo non è sufficiente per Mallett, che hanno creato un motore sovralimentato doppio-turbo da 999 cavalli.
Il costo per la versione sovralimentata sarà di $ 35.795 escluso la vettura naturalmente.

Se partecipate a gare sportive su veicoli a motore, e gareggiate su circuiti privati o anche pubblici, dovete essere muniti di regolare polizza di assicurazione. Tutte le competizioni sportive, rally o motocross, possono svolgersi, solo se l’autorità locale, ha rilasciato una autorizzazione per il suo svolgimento, dopo aver anche preso in visione, la copertura assicurativa civile, che gli organizzatori delle competizioni sono obbligati a stipulare.
Esiste una differenza tra le gare sportive che si svolgono su percorsi aperti al traffico e quelle che avvengono su un circuito riservato.
La polizza assicurativa è necessaria quando si organizza una gara sportiva, per coprire la responsabilità civile, sia contro eventuali danni, che gli stessi veicoli che gareggiano, possono provocare alle persone, sia alle cose che agli animali.
Sono esclusi da tale polizza, i partecipanti alla competizione, e le auto con cui hanno gareggiato nel circuito, sia esso privato che pubblico. Quindi un pilota, potrà scegliere, se vuole, di tutelarsi attraverso una assicurazione per il rischio personale.
Cioè, chi organizza una gara sportiva, non ha responsabilità di ciò che accade a chi guida i veicoli e anche essi stessi, gareggiano consapevoli del rischio che corrono.
Ma il conducente di un auto, è però responsabile, di eventuali danni, che può provocare in un incidente, o durante la gara, se si dimostra un comportamento pericoloso. Questo, soprattutto per le gare su strade aperte al traffico, dove se il danneggiato, è un auto che non partecipa alla gara, sarà sicuramente risarcito del danno.
Insomma è sempre il veicolo sportivo a dover dimostrare la sua innocenza!
Ma passiamo al circuito su cui si gareggia; in questo caso sono valide le regole della competizione a cui si partecipa. Si capovolge il principio esposto precedentemente, e qui, saranno le persone danneggiate a dover dimostrare la propria innocenza e la responsabilità di chi guidava il veicolo sportivo.

Cioè, chi organizza una gara sportiva, non ha responsabilità di ciò che accade a chi guida i veicoli e anche essi stessi, gareggiano consapevoli del rischio che corrono.
Ma il conducente di un auto, è però responsabile, di eventuali danni, che può provocare in un incidente, o durante la gara, se si dimostra un comportamento pericoloso. Questo, soprattutto per le gare su strade aperte al traffico, dove se il danneggiato, è un auto che non partecipa alla gara, sarà sicuramente risarcito del danno.
Insomma è sempre il veicolo sportivo a dover dimostrare la sua innocenza!
Ma passiamo al circuito su cui si gareggia; in questo caso sono valide le regole della competizione a cui si partecipa. Si capovolge il principio esposto precedentemente, e qui, saranno le persone danneggiate a dover dimostrare la propria innocenza e la responsabilità di chi guidava il veicolo sportivo.

Contrassegno assicurativo sul parabrezza
Il contrassegno dell’assicurazione va sempre posto sul vetro anteriore,non sul lunotto o sui vetri laterali del veicolo, e chiaramente leggibile dall’esterno.
la Suprema Corte di Cassazione, ha sancito che, il contrassegno di assicurazione, esposto in modo non leggibile, equivale ad una sua mancata esposizione.
Stiamo però parlando anche di quando la vettura é in sosta, l’ esposizione é tassativa per la vettura ferma;mentre per circolare occorre il certificato ed il contrassegno esposto, ma é il primo ad essere obbligatorio per la circolazione.
I dati contenuti sul tagliando assicurativo sono: la targa dei veicolo che dimostrare che la polizza assicurativa è corrispondente alla macchina; il nome e il logo della compagnia di assicurazione e la scadenza della rata assicurativa.
Non sono obbligati ad esporre il tagliando assicurativo i possessori di motocicli
Ciò è contenuto nel Codice della Strada art.181 e chi non si attiene a quanto disposto, sarà sanzionato per una cifra che va da 21 a 88 euro.
La multa per la mancata esposizione del contrassegno è di 21 euro che verrà ritirata se si porta alla polizia o ai carabinieri,il contrassegno non esposto.
Dal 1998 non è più obbligatorio esporre invece l’attestato di pagamento della tassa di circolazione cioè il bollo auto.
Riguardo al contrassegno di pagamento della tassa automobilistica, a decorrere dall’1 gennaio 1998 l’obbligo di esposizione, per autoveicoli e motocicli, è stato abrogato dalla legge 27 dic. 1997 n. 449, art. 17, comma 24. Limitatamente a detto contrassegno, con la stessa disposizione cessa l’obbligo per i conducenti di motocicli di portarlo con sé
I documenti che bisogna avere sempre avere con sé in auto sono:
la patente, il libretto di circolazione e il certificato dell’avvenuto controllo dei gas di scarico (bollino blu o bollino verde)
Sanzioni: la sanzione che va dai 36 ai 148 euro se si sono dimenticati i documenti a casa.

Kia presenta la nuova Rio e studia l’ibrido
Kia, è decisamente lanciata, in Italia come in Europa, verso posizioni di mercato sempre più prestigiose. Ne è una ulteriore conferma il Salone di Francoforte dove il marchio di Seul si presenta con la sua innovativa gamma di modelli e con qualche chicca che sta a dimostrare l’importante lavoro di preparazione per i futuri modelli.
Dopo l’anteprima al Salone di Ginevra e alla vigilia della commercializzazione della nuova Rio a 5 porte, è la volta della presentazione ufficiale della versione a 3 porte che completa la gamma di un modello destinato ad essere tra i protagonisti nel popolare segmento B in Europa.
La Rio 3 porte mantiene le stesse dimensioni della 5 porte e le stesse doti di abitabilità, ma esprime una forte personalità sportiva che attirerà una nuova fascia di clientela. Sarà commercializzata nel primo trimestre del prossimo anno con una gamma di motorizzazioni analoga a quella della 5 porte.
Inoltre, la sorprendente e originalissima Soul, che finora ha raccolto 45.000 clienti in Europa, ripropone a Francoforte la sua formula alternativa con una versione evoluta nell’estetica e nella meccanica.
E poi c’è il futuro, che in Kia è già perfettamente disegnato e che porterà nei tempi più prossimi a tutta una serie di novità, anche nell’impegnativo campo dell’ibrido, capaci di rispondere al meglio alle attese della clientela soprattutto sotto il profilo dei bassi consumi e delle emissioni contenute.
Intanto, l’evoluzione continua del design Kia si esercita in un esaltante studio di berlina sportiva a quattro posti e quattro porte che prefigura un modello “premium” a trazione posteriore: il KED-8. L’estetica coraggiosa esprime tutto il dinamismo caratteristico della Kia più recenti e aggiunge particolari di pregio nell’utilizzo di materiali non convenzionali. Kia dovrà competere con Honda, sia sull’ibrido con il modello Honda Jazz hybrid, ma dovrà stare attenta anche a modelli come la Honda Accord.
